Enigma Simulations appreciates your support in downloading our products. However, we do have Terms & Conditions and an End User License Agreement (EULA) that we require everybody to understand, cooperate with, honor, and comply with!
By downloading, installing, and/or using any part of the contents of this and any other Enigma Simulations package, you agree to the following Terms & Conditions set forward by this End User License Agreement (EULA).
1) Enigma Simulations provides our products on our terms. That includes that this package is freeware and MUST remain as so. Charging for the whole or any part of our packages is STRICTLY PROHIBITED! We provide our work free of charge and require that every one has fair and equal access to our publically released files and will not be charged whatsoever for them. This includes the illegal act of charging for the packages (whether electronically or by portable media) or charging for server space in which our packages are being hosted. THERE SHALL BE NO PROFITS MADE BY A THIRD-PARTY OFF OF OUR WORK!
2) Our work MAY NOT be bundled with software from a third-party! That software belongs to the original author and we cannot and will not authorize use of their work in our packages. We do however allow other official Enigma Simulations items to be bundled with other official Enigma Simulations items as long as proper credit for the included work is given UNLESS OTHERWISE NOTED!
3) Official Enigma Simulations files are only granted authorization to be uploaded by Enigma Simulations officials to the Enigma Simulations website, SurClaro.com, and SurClaro! Uploading our work by a third-party to any site is NOT AUTHORIZED unless permission is obtained from the individual authors! We will not guarantee support for files that were not properly authorized to upload! We will however allow other sites to link to our files officially uploaded to SurClaro.com and SurClaro
4) Enigma Simulations grants authorization to upload user-created repaints under the following conditions:
a) Official Enigma Simulations textures or files, in part or in whole, may never be used without the proper permission from the original author(s).
b) All textures used in user-created repaints must come from official Enigma Simulations paint kits or must be built from scratch by the user.
c) The creator of user-created repaints may choose to include only textures, or may include a whole package comprising only of only official Enigma Simulations files which include AND ARE LIMITED TO the model, panel, sound, flight dynamics files, and checklist/reference files. Should the user choose to include these files, proper credit shall be given! Use of any official Enigma Simulations texture without permission remains ABSOLUTELY PROHIBITED!
d) Paints are never authorized to be uploaded to !
e) Any third-party software or items MAY NOT be included in your upload!
f) We DO NOT allow user-edited FDE's to be included with any upload! We do not support an user-edited FDEs!
g) Permission is not required to repaint our aircraft as long as the paint kit is used, or all textures are created from scratch by the user. However, the following files ARE REQUIRED TO BE INCLUDED IN EVERY THIRD-PARTY USER UPLOAD; EULA.txt, Credits.txt.
5) Enigma Simulations Flight Dynamics (FDE) files (.air, .cfg) may not be edited or altered in any way, excluding the following exceptions:
a) Including official Enigma Simulations FDE updates.
b) Adding multiple texture entries as required.
We do not support FSX edits which include but are not limited to ground equipment and jetway locations.
6) Third-party Flight Dynamics- While Enigma Simulations does not authorize any edits of our FDE files (except for the noted exceptions in Section 5), we do allow users to create their own FDE files BUILT FROM SCRATCH! Note that Enigma Simulations WILL NOT offer support for any third-party-created FDE files!
7) All logos and files are property of their respective authors/owners and are reproduced for artistic and illustrative purposes only. Use of any files without proper authorization or permission from the respective individual authors is ABSOLUTELY PROHIBITED! This includes altering files for public release, using any
part of a file for public release, or any other use that can be seen in
violation of our Terms & Conditions!
Enigma Simulations DOES NOT authorize any of our official files or user-created files for our products to be uploaded to ! We will not provide support for files downloaded from that site! Any file relating to an Enigma Simulations project shall remain freeware (this includes user-created files)! All files relating to Enigma Simulations projects must remain FREE OF CHARGE! Websites such as FSPlanet have been known charge for downloading files that are freeware and are not cooperative with developers and are in violation of their Terms & Conditions! We apologize if you are ever charged for an Enigma Simulations file, please be informed that you may get these files, for free, from Enigmasim.com, SurClaro.com, or SurClaro!
